陈亮的法度观体现出时势性和公理性两个基本特征,并构成事功主义政治思想的重要前提。作为历史解释的中心范畴,法度表现出因应时代情势而发展的历史主义精神,并试图符合至公的价值目的。法度的公理性主要在于对私性的规范和制约,尤为适应了远古社会之后复杂分化的人类情性。这种体现人为正义的制度安排在现实发展中透露出一种非完美性,需要纠治法度主义的弊病。同时,陈亮透过对祖宗之法的诠释探索积极改革的善治之路。在近世早期,他代表了法度思考的一种高度发展形态。然而,即使像陈亮这样重视法度,究极而言都难以真正认同一种完全客观自行的法度机制理念,并且不能割舍对于人类积极道德能力的乐观主义信念,从而无法摆脱法度与道德智慧之间的紧张性。
Chen Liang’s concept of law reflects the two basic characteristics of current situation and justice, and constitutes an important precondition for the political thinking of the work. As the central category of historical explanation, the law shows the spirit of historicism developed in response to the situation of the times and tries to conform to the value of public affairs. The justice of the law mainly lies in the regulation and restriction of the private property, especially adapted to the complicated human emotions after the ancient society. This institutional arrangement that reflects human justice reveals a non-perfect nature in the realistic development and requires the correction of the defects of legalism. At the same time, Chen Liang explores the good governance path of positive reform through the interpretation of the ancestor’s law. In early modern times, he represented a highly developed form of thinking about law. However, even if Chen Liang attaches great importance to the law, it is very hard for the research team to truly recognize a completely objective and self-concept of the mechanism of law and can not give up optimistic beliefs about the positive moral capacity of human beings and thus can not get rid of the difference between law and moral wisdom Tension.
