“一带一路”作为倡议无法设立新的常设机构以协调投资纠纷,而目前海外投资领域正处于多边机制缺失、区域规则重构、双边BIT有待升级的新格局。为此,有必要在投资规则上有所作为,多边层面不断努力,倡导全球投资规则,争取建立长效机制;区域层面勇于尝试,以RCEP和亚投行为契机,创新规则;双边层面务实合作,升级现有BIT,实现投资便利化和自由化;单边层面深化改革,主动对接新规则,为利用规则并扩大投资合作奠定基础。 “Belt and Road” as an initiative can not set up a new permanent body to coordinate investment disputes, and now the field of overseas investment is in the absence of multilateral mechanisms, the reorganization of regional rules, bilateral BIT to be upgraded to a new pattern.
