我国民事执行中“执行难”和“执行乱”问题一直没有得到有效解决而严重影响着司法公正和司法权威。这主要是因对民事执行缺乏有效的外部监督而引起的。为此,新《民事诉讼法》第235条以基本法律形式确立了检察机关对民事执行的监督权。但新民诉法及新的司法解释还未对监督原则、方式及具体保障机制等作出规定。在实践中如何适用新民诉法对民事执行检察监督的规定又是一个新问题。因此,本文认为执行检察监督应该注重与执行救济制度的配合适用,应当以依法、有限监督为适用原则,以“执行乱”为监督对象、“执行难”为协助对象,以检察建议的方式进行监督来解决我国执行工作中存在的问题。
The problems of “execution difficult” and “execution chaos” in civil execution of our country have not been solved effectively and have seriously affected the judicial impartiality and judicial authority. This is mainly due to the lack of effective external oversight of civil enforcement. Therefore, Article 235 of the new Code of Civil Procedure establishes the procuratorial power to supervise civil execution in the form of basic law. However, the new Civil Procedure Law and the new judicial interpretation have not yet laid down the principles, methods and specific safeguard mechanisms for supervision. How to Apply the New Civil Procedure Law in Prosecutorial Supervision of Civil Enforcement in Practice Is Yet A New Issue. Therefore, this paper argues that the implementation of the procuratorial supervision should be paired with the implementation of the relief system, should be based on the principle of legality and limited supervision as the principle, “execution chaos ” as the object of supervision, “difficult to enforce ” as the object of assistance to prosecutors The proposed method of supervision is to solve the problems existing in the implementation of our country.
