《工伤保险条例》规定:职工因工作遭受事故伤害或患职业病需要暂停工作接受工伤医疗的,在停工留薪期内,原工资福利待遇不变,由所在单位按月支付。但对于职工在停工留薪期内已回到单位上班,而单位又支付工资的情形,用人单位还需支付停工留薪期的工资吗?本案分析可供参考。
The Regulations on Work-related Injury Insurance stipulate that employees who need to suspend work due to work injury or suffering from occupational diseases and receive work injury medical treatment shall be paid monthly by their work unit within the period of stoppage pay and benefits. However, for employees who have returned to work during the period when their work stoppages have been paid and units have paid their salaries, will the employer still be required to pay salaries for suspension of work or pay? The analysis in this case is for reference.
