随着工业化和城镇化发展的加快,农村房屋及宅基地的流转数量日益增多,但流转现实和现存法律之间存在很大矛盾。如何界定农村宅基地流转的合理性和合法性已是当前关注的重点,产权性质的确定更是其基础。在现有研究观点基础上,结合马克思主义土地产权理论,以“土地产权权能既可结合又可分离”为核心,创新宅基地产权制度安排,并逐步实现宅基地产权的交易商品化和配置市场化,对完善我国农村宅基地产权制度、促进农村发展、提高农民收入有着重要指导意义。
With the acceleration of industrialization and urbanization, the number of rural houses and homesteads is increasing, but there is a great contradiction between the realities of transfer and the existing laws. How to define the rationality and legitimacy of rural housing land transfer is the focus of current attention, and the nature of property rights is the basis. On the basis of the existing research and combined with Marxist theory of land property rights, we should innovate the arrangement of property rights of homestead land based on “land property rights can both combine and separate ”, and gradually realize the commercialization of the homestead land property rights and The allocation of marketization has an important guiding significance for perfecting the property rights system of rural house sites in rural areas, promoting rural development and raising farmers’ incomes.
