全国人大常委会四次解释香港基本法的启动程序,两次是由香港特别行政区行政长官请求国务院提请全国人大常委会释法,一次是委员长会议提请,一次是终审法院提请。特首请求释法在程序上有瑕疵,有《基本法》的执行权不等于有实施权;其请求释法超出了对中央“负责”的范围,在《立法法》上也难以成立。委员长会议提请释法在《立法法》上缺乏依据。香港全国人大代表没有释法提出权。香港特别行政区终审法院提请的第四次释法符合《基本法》规定的程序。
The NPC Standing Committee four times explained the procedure for launching the Hong Kong Basic Law. The two requests were made by the Chief Executive of the Hong Kong Special Administrative Region to request the State Council to submit the NPC interpretation to the NPC Standing Committee. Chief Executive requested interpretation of the law flawed in the procedure, there is “the implementation of the Basic Law” does not mean the implementation of the right; his request for interpretation of the law is beyond the scope of the “responsible” the “Legislation Law” is also difficult to set up. The chairman’s meeting drew the explanation for the lack of basis in the “Legislation Law.” The NPC deputies in Hong Kong have no right of interpretation. The fourth release of law drafted by the Court of Final Appeal of Hong Kong Special Administrative Region meets the requirements of the Basic Law.
