2015年中央经济工作会议将推动企业破产上升作为供给侧结构性改革战略任务之一。金融债权的实现率关乎金融的稳定,而破产实践中金融债权人的利益,往往又极易被忽视。本文从江西赛维LDK案入手,分析了该案中对于金融债权保护不到位的主要症结点,并随后结合破产管理人团队正在实施的某股份制银行在ST西南某上市公司的破产重整案,探讨从积极成为债委会委员发挥作用、关注债务人财产的完整性、重视资产评估方法选定等七个方面,加强对于破产程序中金融债权的保护。
The 2015 Central Economic Work Conference will promote the rise of corporate bankruptcy as one of the strategic tasks of supply-side structural reform. The realization rate of financial claims relates to the stability of finance. However, the interests of financial creditors in bankruptcy are often overlooked. This article starts from the LDK case of LDK in Jiangxi and analyzes the main crux of the case in which the protection of financial claims is not in place. Then with the bankruptcy reorganization case of a joint-stock bank in the southwest of ST, It explores the protection of financial claims in bankruptcy proceedings from seven aspects: actively becoming a member of the debt commission, paying attention to the integrity of the debtor’s property, and attaching importance to the selection of methods for asset valuation.
