我国的区际司法协助,内地与港澳采“安排模式”、大陆与台湾地区采“单向分别立法结合双向协议”模式。尽管模式不同,表面上的属性不同,内地与港澳、大陆与台湾的司法文书送达,主要依托公权力进行。不同模式下的送达规定互有异同、各有不足。“安排”和“双向协议”的共同特点是双边协商、分别执行,最高人民法院通过单方改进做法,制定司法解释以解决司法文书送达的困难,但也引发如何理顺协商与执行问题的思考。我国区际送达应利用多种途径,且进一步提高委托送达效率。
