“着手”一词指某种行为的开始,只不过还是处于行为实施的起点。犯罪着手在司法认定上起着重要作用,是区别犯罪预备与犯罪未遂的关键标志。关于“犯罪着手”的认定标准问题,在国内外刑法理论界也没有形成一个统一认识。基于犯罪着手认定的重要性,本文以“新行为理论”作为切入点,提出新的认定标准,并将提出的新标准运用到共同犯罪着手的认定中。 The word “get started” refers to the beginning of some kind of behavior, but it is still at the beginning of the action. Crime initiation plays an important role in the judicial determination, which is the key mark to distinguish crime preparation and attempted crime. On the “crime to start ” identification standards, criminal law at home and abroad did not form a unified understanding of theorists. Based on the importance of criminal identification, this paper uses “new behavior theory ” as a starting point, puts forward new identification standards, and applies the proposed new standards to the identification of joint criminal proceeding.
