本文援引中国法院针对外观设计相同相似性判断的案例,探索在外观设计以及商标的相同相似性判断中涉及心理学的认知规律的问题,提出在知识产权的行政和司法审理当中,引入心理学的认知方法,使外观设计的相同相似性判断更为客观、科学和更具有说服力,以此增强行政和司法机关的公信力、摈除外观设计相同相似判断上的主观随意性。同时提出了一个将心理学方法适用于知识产权审理之中的设想和具体方法。
