目的:通过对药品虚假广告的定义、特点了解现在药品市场上虚假广告的现状,进而提出若干思考和建议,为追究虚假药品广告违法责任时起到抛砖引玉的作用。方法:采用理论、个案、综合分析法,结合药学和法学的相关知识对虚假药品广告中责任主体的民事责任、刑事责任、行政责任进行综合探究和讨论。结论:通过对虚假药品广告中责任主体的违法责任进行研究,以期保护药品消费者的合法权益。
OBJECTIVE: Through the definition and characteristics of false advertisements of pharmaceutical products, we can know the current status of false advertisements in the pharmaceutical market now, and then put forward some suggestions and suggestions, which play a valuable role in investigating the illegal drug advertisements. Methods: Using theory, case and comprehensive analysis method, combined with the related knowledge of pharmacy and law, this article made a comprehensive inquiry and discussion on the civil liability, criminal responsibility and administrative responsibility of the responsible party in the fake medicine advertisement. Conclusion: Through the research on the liability of the responsible party in the fake medicine advertisement, with a view to protecting the legitimate rights and interests of drug consumers.
