随着我国社会主义市场经济体制和市场价格机制的建立,经济的快速发展,特别是市场供求格局的转化,市场上各行各业各类商品降价竞争的现象日趋频繁。降价竞争(或叫降价战、价格战)已成为当今市场经济发展进程中一种带有普遍性的现象。对公开、公正、公平的市场价格竞争行为,广大消费者拥护、欢迎,政府予以大力支持、依法保护,这是毫无疑问的。但在价格竞争中,有许许多多是“挂羊头,卖狗肉”的“假降价、真骗客”的行为,既扰乱市场价格竞争秩序,又侵害消费者的合法权益。笔者认为,在降价竞争大潮中,认真探究虚假行为的表现形式、产生的根源以及治理对
With the establishment of China’s socialist market economic system and market price mechanism and the rapid economic development, especially the transformation of the market supply and demand pattern, the phenomenon of price competition of various commodities in all walks of life in the market is becoming more frequent. Price-cutting competition (or price war, price war) has become a common phenomenon in the process of market economy development. There is no doubt about the open, just and fair competition in the market price, the support and advocacy of the broad masses of consumers, the strong support from the government and the protection according to law. However, in the price competition, many are “fake prices and deceiving customers”, which disrupt market order and compete with consumers’ legitimate rights and interests.
