商标都是识别性的商业标识,属于知识产权范畴,蕴含着一定的商业价值,市场知名度越高,对消费者的影响力就越大,商业价值自然也就越高。近年来,随着市场经济的发展和竞争的日趋激烈,一些投机者为了争夺市场,扩大影响,片面实现追求经济利益的最大化的目标,通过各种途径钻法律的空子,“傍名牌”、“搭便车”等现象愈来愈严重,商标相似侵权的表现形式也呈现变得越来越多样化。本文主要从商标相似侵权的定义、理论基础、认定方法、处理以及完善等方面来对其进行分析和探讨。
