“不可克减的权利”是指缔约国在任何情况下,包括紧急状态或战争时期,都不得减损或损害人权条约所规定的某些特定权利。到目前为止,一些综合性人权条约以及国际人道法条约都规定了不可克减的权利条款。本文主要通过对人权条约的不可克减权利条款、司法判例、人权条约机构的解释以及国际法学界见解的综合考察,分析人权条约所规定的不可克减权利与习惯法规则之间的关系。
“Non-derogable rights” means that a State party must not impair or impair certain specific rights under human rights treaties under any circumstances, including emergency situations or wars. So far, a number of comprehensive human rights treaties and IHL treaties have provided for non-derogable rights clauses. This article analyzes the relationship between the non-derogable rights stipulated in the human rights treaties and the rules of customary law mainly through the non-derogable rights provisions of human rights treaties, judicial precedents, the interpretation of human rights treaty bodies and the comprehensive investigation of the opinions of international jurisprudence.
