目的:规范药品广告的刊播,确保药品市场竞争有序开展,保证用药的安全有效。方法:根据国家食品药品监督管理局、国家工商总局公布的药品广告审批、查处数据,结合工作实际,对药品广告的法律现状进行分析,对存在的问题提出改进建议。结果:目前我国药品广告监管的法律建设已取得了长足进步,有力地防止了违法广告、虚假广告刊播。结论:面对广告宣传手段和广告发布媒介的不断变化,仍需要通过不断调整审批制度、监管机制、查处力度、条款规定等方面的法律制度,来确保监管的有的放矢,推动药品监管工作规范化进程,保证人民群众用药安全有效。
OBJECTIVE: To standardize the publication of drug advertisements to ensure the orderly competition in drug markets and ensure the safe and effective use of drugs. Methods: According to the approval, investigation and punishment of drug advertisements released by the State Food and Drug Administration and the State Administration for Industry and Commerce, the legal status quo of drug advertisements was analyzed combining with the actual work, and suggestions for improvement were put forward.
