武汉市的快速发展在引领周边城市的发展方面起着重要作用,但作为其最突出内部矛盾的城市房屋拆迁补偿问题,却成为制约其和谐长足发展的一大瓶颈。针对因行政权的越位、缺位、错位对被拆迁人合法权益的侵犯,必须依新颁行的《国有土地上房屋征收与补偿条例》(以下简称新条例)进行严格的法律规制,让政府公权力回归本位,并重新配置拆迁人和被拆迁人的私权利,从权力和权利方面着手使政府、拆迁人、被拆迁人利益达到动态平衡,促进房屋拆迁的和谐进行。
