我国刑法修正案(八)增设拒不支付劳动报酬罪,以刑事司法对劳动报酬权进行保护,《最高人民法院关于审理拒不支付劳动报酬刑事案件适用法律若干问题的解释》进一步对此类案件的办理进行了明确。但劳动者维权成本的增加,罪名执行效果的不尽理想,刑事司法与其他治理手段的衔接机制不健全等问题的存在,使劳动报酬权的刑法保护依然面临困境,所以,对以上问题的解决办法进行研究就显得十分必要。
