我国已经进入老龄化社会,老年人的养老与监护是不可回避的社会问题。当前我国老年人监护制度在监护人主体资格、监护人权利、监护内容层次性、监护监督人方面仍存在尚需填补的空白。应当在借鉴他国经验的基础上,更新立法理念,充分发挥公权力作用,同时完善相应的制度。 Our country has entered an aging society. Elderly care and support is an unavoidable social problem. At present, there is still a gap that still needs to be filled in guardianship system of the elderly in our country as the main body of guardianship, guardian rights, the hierarchical nature of guardianship, and the supervisor of guardianship. Based on the experience of other countries, we should update the concept of legislation, give full play to the role of public power, and at the same time improve the corresponding system.
