2012年3月教育部副部长杜玉波在“全面提高高等教育质量工作会议上的讲话”中明确指出“要把教学内容、教学方法、教学模式改革作为高等教育教学和人才培养的最基础性工作,大力推进启发式、探究式、讨论式、参与式教学,加强师生互动。”研讨式教学法的代表是“席明纳”教学法。“席明纳”教学模式源于德国,19世纪后成为西方现代大学教学方法的重要支柱之一,重在训练高校学生的开放自由的学术思辨能力。我国高校法学学科应通过增设“席明纳”研讨课程,积极进行教学改革尝试,使高校法科学生在教师的引导下,通过自主研究与集体讨论,进行知识构建,体验法学研究方法,进而充分培养其分析问题、研究问题、解决问题的能力,实现法学人才培养模式的改革实践目标。
