刑事被害人救助制度最早可追溯至3600多年前的古巴比伦,当时的《汉穆拉比法典》第23条规定:“如果强盗未能捕获,被劫者应于上帝前请求其失物;窃盗发生地之城市与长官应回复其所失物。”第24条规定:“如生命被害时,城市与长官应赔偿其人民一名那(注:名那,是当时的金钱衡量单位)。”二战以后,英国、美国、新西兰、日本等国家相继建立刑事被害人救助制度。我国至今尚未建立刑事被害人救助制度,随着社会的进步,法律对犯罪人的权利保障越来越充分,反之对被害人的权利保障却相对簿弱,对刑事被害人进行救助已成为当务之急。
