借鉴巴泽尔产权理论分析“零负团费”现象从中揭示出:旅游产品多种属性的相对独立性决定了其涉及权利和价值的可分离性,具有机会主义动机的旅行社可以通过一系列边际调整行为,来攫取被置于公共领域内无偿属性价值;游客可以通过相应的成本-收益比较分析,选择是否与旅行社进行产权博弈以保护所拥有的法律权利;旅游市场监管产权的分割,使得监管本身成为一个公共领域。多元化的旅游产品和成熟的旅游消费心理可以从源头上抑制“零负团费”现象,我国旅游市场监管体制应向一体化监管模式和多中心治理模式转变,只有明晰旅游产品及相应监管的产权,建立政府-市场-消费者之间良性的互动关系,才能有效规制“零负团费”行为。
