权利和义务(非特殊标明,下文所用的“权利”、“义务”皆为“法律权利”、“法律义务”。)作为法理学的一对基石范畴,二者在法学体系中理应居于同等位置。然而,现时的法学家大多偏爱于对能激励人们行为的权利进行研究,对义务的讨论或是附着于对权利的研究,甚或是视而不见,这大概是基于他们对权利和义务的关系的认识而导致的这样的一种状态。他们认为法律义务附着于
