具备作品构成要件的广告语应可成为著作权的客体,这符合著作权法的立法精神。除著作权法外,商标法可对符合商标构成要件的广告语进行更有效保护。广告语征集广告并非悬赏广告,而是一般合同缔结中的要约或要约邀请。
Advertising slogans that have the composition of the work should become the object of copyright, which is in line with the legislative spirit of copyright law.
