公开权是商品化权项下形象权的一个方面,是每一个自然人所固有的、对其人格标识的商业使用进行控制的权利。世界各国对公开权这一新型的权利,都依照本国的法律现实,选择了各种不同的保护模式。我国也应根据国情,创建一个以人格权保护为主、以商标法与竞争法保护为补充的公开权保护模式。
The right of publicity is one aspect of the right of image under the right of commercialization and the right of every natural person to control the commercial use of its personal identifier. All countries in the world have chosen a variety of protection modalities in accordance with the legal reality of their own country. In our country, we should also create a protection model based on the protection of personality rights with the protection of trademark law and competition law as the supplement according to the national conditions.
