随着近些年房地产市场的大热,房产价值的不断攀升,关于房子的纠纷也越来越多。虽然《物权法》明确规定不动产产权的归属和内容依据不动产登记簿的登记确定,但是在现实生活中存在着大量的房产登记名义人与实际权利人不一致的情形。而由于国家政策的调整,借名买房的现象开始频频发生,由此引发的房产纠纷也逐渐开始被各界所关注。本文旨在通过分析房产借名登记中所涉及的一些法律问题,对借名登记购房协议的效力、风险防范及特殊情况加以梳理。
With the real estate market in recent years, the real estate boom, the rising value of real estate, more and more disputes about the house. Although the Real Right Law clearly stipulates that the ownership and content of real property rights are determined according to the registration of the real property registration book, there are a large number of situations in real life where the real name owners and the actual right holders do not agree. Due to the adjustment of national policy, the phenomenon of buying a house by name began to occur frequently, and the real estate disputes triggered by it are also gradually beginning to be paid attention by all walks of life. The purpose of this paper is to analyze the validity of the registered purchase agreement, risk prevention and special circumstances by analyzing some legal issues involved in the registration of real estate title registration.
