法律人类学在西方的兴盛,伴随着殖民运动的层层推进,对象则是本国原住民与后发国族的生活样态。其例如马林诺夫斯基教授对于南太平洋岛屿的田野调查,呈现出的是现代西方视野下的异质文明的马赛克,而以初民社会的“习惯法”一言以蔽之。其后兴起的各种研究,包括作为前期立法准备、对于民间“风俗习惯”的调查,统归于“习惯法”或者“民间法”名下,多半不脱此臼。
The prosperity of legal anthropology in the West, accompanied by the progressive promotion of the colonialist movement, is based on the living patterns of the indigenous peoples and late-developing nations. For example, Prof. Malinowski’s fieldwork on the South Pacific islands presents a mosaic of heterogeneous civilizations from the perspective of the modern West, in a nutshell to the “customary law” of the early civil society. The various studies that followed, including the preparations for the previous legislative preparations, and the investigation of folk customs and customs, were mostly classified under the “customary law” or “civil law”, most of which would not be detached.
