行政裁量是行政法的核心概念。因此对于行政裁量及其治理进行研究可以为规范和正确运用行政权力提供理论性的保障,有利于推进行政法治化。本文着重分析了行政裁量存在的必要性以及行使行政裁量权过程中存在的弊端,最后结合当今现实提出了针对行政裁量的弊端进行治理的路径。 Administrative discretion is the core concept of administrative law. Therefore, the research on administrative discretion and its governance can provide theoretical guarantee for regulating and correctly using administrative power, which is conducive to promoting the administrative rule of law. This paper analyzes the necessity of the existence of administrative discretion and the disadvantages in the process of exercising administrative discretion. Finally, the paper puts forward the path of governing the malpractice of administrative discretion according to the present reality.
