案例:2011年8月,武汉陈女士在经过一栋大楼楼下时,被一块高空坠落的玻璃砸伤头部。事后,物业公司和楼上的住户都说坠落的玻璃和他们无关。无奈之下,陈女士将物业公司和缺失玻璃的几户居民共同告上法庭。请问法院如何判决?说法:《侵权责任法》第87条规定,“从建筑物中抛掷物品或者从建筑物上坠落的物品造成他人损害,难以确定具体侵权人的,除能够证明自己不是侵权人的外,由可能加害的建筑物使用人给予补偿。”
Case: In August 2011, Ms. Chen in Wuhan was hit by a piece of glass falling down from the sky when going downstairs from a building. Afterwards, both the property company and the upstairs tenants said the falling glass had nothing to do with them. In desperation, Ms. Chen will be the property company and a few households missing glass together to court. How does the court decide? Argument: Article 87 of the Tort Liability Act stipulates that “[t] he torture of objects in buildings or articles falling from buildings causes damage to others and makes it difficult to identify a specific infringer unless they can prove that they are not infringing People, compensated by the user of the building may harm. ”
