电子商务纠纷的小额性、全球性等特点,意味着通过传统的法院诉讼方式或仲裁机构仲裁方式来解决,在很大程度上是不经济的,也是难以有效实现的。随着互联网带来的便利,建立与电子商务配套的快速、经济的纠纷解决机制的迫切性日益凸显。以互联网为基础的在线纠纷解决机制(ODR)提供了一种解决方案。文章通过研究发现,ODR满足了解决电子商务纠纷的需要,并且在解决B2C电子商务纠纷中具有独特的优势,然而ODR在发展过程中还存在着一些问题有待从多方面努力进行规范,以便更好地为电子商务服务。
The small-scale and global nature of e-commerce disputes mean that it is not economical or feasible for them to be settled through traditional court litigation or arbitration by arbitration agencies. With the convenience brought by the Internet, the urgency of establishing a fast and economical dispute resolution mechanism that is compatible with e-commerce has become increasingly prominent. Internet-based online dispute resolution (ODR) provides a solution. The study found that ODR meets the need of resolving e-commerce disputes and has a unique advantage in resolving B2C e-commerce disputes. However, there are still some problems in the development of ODR that need to be regulated in many aspects so as to be better E-commerce services.
