对贪腐犯罪,根据其罪行轻重,实行“重其重者,轻其轻者”的处罚,本无可厚非。但实施的却不尽如人意:那些罪行较重的贪腐分子,由于担心所犯罪行一旦败露,必将得到法律的严厉处罚,有时抱着“好死不如赖活”的心态一条道走到黑;罪行较轻的贪腐分子,则因为罪行较轻未受到伤筋动骨的惩处,逐步变本加厉,任由小贪小腐变为巨贪巨腐。腐败问题如不进行有效地治理,必将造成亡党亡国的悲剧。笔者认为,应从新审视“重其重者,轻其轻者”传统防腐路径的实施效果并提出了“重其轻者,轻其重者”的防腐倡廉新路径。
It is understandable that a crime of corruption should be punished according to the gravity of its crimes if it is to be given the highest priority and the least severe. However, the implementation is not satisfactory: those criminals who have committed heavier crimes will be severely punished by law as they fear that the crimes they have committed will be severely punished, sometimes with the mentality of “being better off than living on their laurels.” Going black; less guilty of corrupt elements, because the crime was lighter and not be punishable by punishment, gradually worsened, let the small corruption into corruption. Corruption, if not effectively controlled, will surely result in the tragedy of going to the party and nation. The author believes that we should reexamine the implementation of the traditional anti-corruption approach and put forward a new approach to safeguard corruption and build a clean government that emphasizes the most important and the most important ones.
