我国《食品安全法》第79条关于食品安全信用档案制度的规定过于单薄,需要借助企业征信制度和企业信息公示制度将其升级为食品企业征信制度。食品企业征信系统的运行有助于开辟食品安全社会共治新模式、有助于发挥食品企业“红黑名单”制度效应、有助于解决食品消费领域信息严重不对称问题。在建构食品企业征信制度过程中,应着力规制食品企业征信机构的信用信息收集行为、评级行为和共享行为。
Article 79 of the “Food Safety Law of the People’s Republic of China” on the provisions of the food safety credit file system is too weak. It is necessary to upgrade it to the credit system of food enterprises by means of the enterprise credit information system and the enterprise information publicity system. The operation of credit information system in food enterprises helps to open up a new mode of social co-governance for food safety and helps to exert the system effect of food and beverage companies and help to solve the serious asymmetric information in the field of food consumption. In the process of constructing the credit system of food enterprises, efforts should be made to regulate the credit information collection behavior, rating behavior and sharing behavior of credit agencies of food enterprises.
