公用事业的行政特许经营是公私合作的一种形式,为保证公用事业的持续供给和服务质量,政府需要加强对特许企业的监管,当特许企业存在违法或其他情形时,政府可以强制终止行政特许经营协议。行政特许经营协议的强制终止可以从行政合同的目的、行政优益权和行政应急性等方面进行考察,分析其正当性问题,对行政特许经营协议的强制终止,也会侵犯到特许经营企业的权益,需要对强制终止行为加以规范。应从实体法与程序法方面对强制终止行为加以规范,以维持特许企业权利保护和公共利益需要之间的平衡,并对特许经营协议终止后的双方责任加以公平分配。
