与传统行政法律关系双方主体地位不对等的模式不同,现代行政法律关系呈现出平权型发展趋势。平权型行政法律关系强调相对人和行政主体平等地拥有相当的权利,进行相对应的交往,进一步突显出人的主体价值与行政过程的民主性。平权型行政法律关系,可通过强化相对人权利、弱化行政主体权力予以实现。行政法律关系平权型发展趋势对传统公私法的二元划分提出了挑战,但其并非绝对的,存在范围及程度上存在一定的限制。
Different from the traditional model of unequal status of both parties in administrative law, the modern administrative law shows the trend of affirmative-official development. Affirmative administrative law emphasizes that relative people and administrative entities have equal rights and corresponding exchanges, further highlighting the values of people’s subjectivity and the democratization of administrative processes. Affirmative administrative and legal relations can be achieved through strengthening the rights of relative persons and weakening the power of administrative bodies. The legal-affirmative trend of administrative law has challenged the dual division of traditional public-private law, but it is not absolute. There are limits to the range and extent of the law.
