三机关分工负责、相互配合、相互制约原则是我国刑事诉讼法独立发展和长期发展的产物,拥有复杂的发展背景。三机关分工负责、相互配合、相互制约原则表述的深层内容描述了我国三机关的地位和相互关系,是公、检、法三机关在国家机关中的权力分配和地位。在我国司法体系重建的过程中,为公、检、法三机关的地位和作用进行了划分,为三机关之间程序法意义上的“定纷止争”作出了贡献。但是随着新的刑事诉讼法的运行,刑事诉讼程序中的问题就使得这一原则的模糊性和矛盾性的弱点暴露了出来,以原有的思路和定位无法解决新的问题。三机关分工负责、相互配合、相互制约原则也为我国刑事诉讼法的发展和完善作出了应有的贡献,但是从科学和实效的角度来看,三机关分工负责、相互配合、相互制约原则存在着严重的不足,突显着我国刑事诉讼法特别是刑事诉讼法基本原则与时代脱节的落后。因此,我们应当加强公理性原则的使用,从而增强法律的科学性。
