该文根据现行婚姻法对财产制度的有关规定、审判实践中遇到的疑难问题,就有争议的夫妻共同财产和个人财产的认定标准问题展开分析。本文认为,认定夫妻争议中的财产是共同财产还是个人财产,需要依照婚姻法及相关司法解释的规定,并根据争议财产的属性是否具有人身依附性进行判别。 According to the relevant provisions of the present marriage law on the property system and the difficult problems encountered in the trial practice, this article analyzes the controversial criteria for determining the common property and individual property of the couple. This article argues that the identification of marital disputes in the property is a joint property or personal property, in accordance with the provisions of the Marriage Law and related judicial interpretations, and according to the disputed property whether the personal attachment to judge.
