网络电子交易的兴起在给人们带来便利的同时也引起了很多法律问题,商标侵权便是其中之一。在网络电子交易平台用户实施商标侵权行为、销售侵犯商标权的商品时,该交易平台的提供者是否应承担法律责任?本文认为,如淘宝、易趣等网络电子交易平台提供者本身并不参与商品或服务的实际交易,是独立于买卖双方当事人的,没有实施任何侵犯原告商标专用权的行为,因此不构成直接商标权侵权。只有其在主观上明知或应知而不知的时候,可能构成间接侵权。网络电子交易平台提供者在接到相关权利人符合规定的通知之后,应当及时断开链接和删除侵权商品信息,否则将就通知之后的扩大部分损失承担连带赔偿责任。
The rise of online electronic transactions has brought many legal issues while bringing convenience to people. Trademark infringement is one of them. When the users of online electronic trading platform implement the trademark infringement and sell the goods infringing the trademark right, should the provider of the trading platform bear the legal liability? This article argues that the providers of online electronic trading platform such as Taobao and eBay do not participate in the goods themselves Or the actual transaction of the service is independent of the parties to the buyer and the seller and has not implemented any infringement on the plaintiff’s exclusive right to use the trademark and therefore does not constitute a direct trademark infringement. It may constitute an indirect infringement only if it is known subjectively or should not be known. Upon receipt of the notification of compliance by the relevant obligee, the provider of the network electronic trading platform shall promptly disconnect the link and delete the infringing commodity information, otherwise liability for the joint loss will be borne by the provider of the network electronic trading platform.
