随着城镇住房制度改革的加快和房地产热升温,个人买卖私房正呈上升趋势。在私房交易中,不少人认为:只要订立了房屋买卖合同,产权便可转移,而疏于去房管机关办理过户手续。国家在充分保护个人对房屋的所有权,允许私房交易的同时,也明文规定,私房买卖必须到当地房管部门办理过户手续,产权方可转移。因为,房产交易属于大宗商品买卖,不同于普通的商品交易。
With the acceleration of urban housing reform and the warming of real estate, personal private houses are on the rise. In private transactions, many people think: as long as the signing of the contract for the sale of housing, property rights can be transferred, but negligent to the Housing Authority for transfer procedures. While fully protecting individual ownership of houses and allowing private transactions, the state also stipulates explicitly that private-owned buyers and sellers must go to the local housing administration department to handle the transfer procedures before the property rights can be transferred. Because, real estate transactions belong to commodity trading, different from ordinary commodity trading.
