互联网领域优势传导效应与反垄断规制--以双边市场为视角

互联网行业的蓬勃发展让优势传导效应映入人们眼帘,它不同于传统行业中的垄断力传导,而是在双边市场结构下进行的相对优势地位的传导效应。互联网企业普遍带有双边市场特征,在双边市场的运行和结构演进过程中,会自发进行优势传导,这构成了优势传导效应的合法性基础;同时,企业的特定经营行为会加强优势传导效应,带来排除、限制竞争的结果,这构成了反垄断规制的必要性基础。优势传导有三条路径,分别是双边市场内传导、多边市场内传导和跨平台传导。本文以此为突破口,试图揭示每条路径下优势传导效应的内在机制、传导效率和反竞争效果,并提出相应的反垄断规制立场。 The vigorous development of the Internet industry brings the advantage of conduction effect into the eyes of the people. It is different from the conduction of monopoly power in the traditional industries, but is the conduction effect of the relative superiority status under the bilateral market structure. Internet enterprises generally have the characteristics of bilateral markets. In the course of the operation and structure evolution of bilateral markets, they will conduct dominant transmission voluntarily, which forms the basis for the legitimacy of dominant conduction effects. At the same time, the specific operating behaviors of enterprises will strengthen the dominant transmission effect, The result of exclusion and restriction of competition constituted the necessary basis for antitrust regulation. There are three channels for the conduction of advantages, which are the conduction within the bilateral market, the conduction within the multilateral market and the cross-platform transmission. This article takes this as a breakthrough to try to reveal the internal mechanism, conduction efficiency and anticompetitive effect of the dominant conduction under each path, and put forward corresponding anti-monopoly regulatory standpoints.
