迪特尔·梅迪库斯曾说过:“法律行为是民法的核心概念!是实现民法私法自治理念的主要工具!或者说是每一个人通过自己的行为形成法律关系的手段。”但是我国传统的民法理论对民事法律行为的定义是有缺陷的。本文认为法学界长期以来对法律行为本质的争论归根结底是对法律行为概念的不同理解所致,因此,统一对概念的认识是定纷止争的关键。 Dieter 梅迪库斯 once said: “The legal act is the core concept of civil law! It is the main tool to realize the idea of ​​autonomy of civil law private law, or it is the means by which everyone forms a legal relationship through their own actions.” " However, the definition of civil legal act in China’s traditional civil law theory is flawed. This dissertation argues that the controversy over the nature of legal acts has long been attributed to different understandings of the concept of legal acts. Therefore, unifying the concept of concepts is the key to determining the ultimate goal of legal action.
