本文展示了在新农村建设过程中地价上升的背景下,一个集体共有的水塘以及农户水田被乡村混混霸占的故事,阐述乡村灰色暴力在农地产权实践过程中的作用。灰色暴力成为乡村地权实践过程中的支配要素,是转型期乡村社会结构混乱、农业税费改革后乡镇治权弱化、农村人口大规模外流、司法保护能力不足等乡村治理因素相互交织的结果。在这样一个乡村治理转型的大背景下,灰色势力进入以后,即使是农地产权完整清晰也不一定能保护农户的农地权益。
This paper shows the story of a pool of collectives and the paddy fields of peasant households occupied by rural dams under the background of rising land prices during the construction of new rural areas and expounds the role of rural gray violence in the practice of farmland property rights. Gray violence has become the dominant factor in the practice of rural land ownership. It is the result of intertwined rural governance factors such as the chaotic social structure of villages in transition, the weakening of township governance after the reform of agricultural taxes and fees, the massive outflow of rural population and the inadequate judicial protection. In such a background of rural governance transformation, even after the gray forces entered, even the complete and clear ownership of farmland may not be able to protect the rights and interests of rural households.
