劳动权是劳动法学的核心范畴 ,强化对劳动权范畴的深层次探究 ,既是劳动法学学科发展的理论任务 ,也是劳动法制建设的现实需求。劳动权构造的“权利群”现象、主体利益需求的多样性以及义务对应的多元化都决定了劳动权属性的多重性、复杂性 ,也决定了劳动权必然具有多重的精神意蕴 :生存理念与发展理念相并行 ;社会权属性与自由权属性相兼容 ;物质利益与人身、人格利益相统一 ;倾斜保护与平衡协调相结合。比较而言 ,劳动权范畴中的发展理念、自由权属性、人格法益、平衡协调机能往往被忽视 ,应该突出予以阐释和强调。
The right to work is the core category of labor law. Strengthening the exploration of the scope of labor rights is not only the theoretical task of the discipline of labor law, but also the realistic demand of the legal system of labor. The “rights group” phenomenon of labor rights structure, the diversification of the needs of the main interests and the corresponding diversification of obligations all determine the multiplicity and complexity of the labor rights, and also determine that the labor rights necessarily have multiple spiritual connotations: the concept of survival and Development concepts are in parallel; social rights are compatible with the attributes of free rights; the material interests are integrated with personal and personal interests; and the combination of tilt protection and balance coordination. In comparison, the concept of development, the attributes of free rights, the law of personality and the function of balance and coordination in the scope of labor rights are often overlooked and should be highlighted and emphasized.
