“旧楼加装电梯”已成为当今社会涉及民生的重大问题,旧楼如何加装电梯、“人民内部矛盾”如何解决等问题摆在眼前,当纠纷诉至法院,撇开政府应起积极作用外,“旧楼加装电梯”涉及的法律问题将成为法院无法回避的事实。本文以一起低楼层业主状告增建电梯报建及施工单位物权保护纠纷为切入点,从建筑物区分所有权、区分所有建筑物相邻关系、建筑物内相邻关系的限制三个方面分析,揭露建筑物高、低楼层业主利益冲突的实质。通过分析现有地方规范性文件,借鉴大陆法系相关规定,尝试设置具有较强操作性的经济补偿机制,以期实现对权利受限制一方的事后救济。
