劳动者通过集体行动来解决劳动争议是企业内部劳动力市场与外部宏观环境共同作用下的一种非常规维权行为,其主要表现形式为停工、怠工、罢工等。产生原因包括劳动者个人权益形成了集体诉求权益、企业经营管理中经常忽视伦理道德规范的作用、企业内部化解劳动争议的机制效率低下、社会转型期环境风险的影响等。劳动者群体性事件有着潜在的破坏性,会造成经济和社会损失,也可能会形成社会风险,造成社会不稳定;但同时也有着一定的正面意义。对此,我们要以包容性的发展理念来看待劳动者群体性事件,积极创新完善有效的劳资关系调整体制机制,并防范群体性事件演变为社会危机。
Workers through collective action to resolve labor disputes is an unconventional act of rights under the joint action of the internal labor market and the external macro-environment. The main manifestations are stoppage, sabotage and strike. The causes include the individual rights and interests of laborers, the rights and interests of collective claims, the omission of ethical norms in business management, the inefficient mechanism to resolve labor disputes in enterprises and the impact of environmental risks in social transition. The mass incidents of laborers are potentially devastating, causing economic and social losses, creating social risks and causing social instability. However, they also have certain positive implications. In this regard, we should treat the mass incidents of workers with the concept of inclusive development, actively innovate and improve the system and mechanism of adjusting the relations between labor and capital, and prevent the mass incidents from evolving into a social crisis.
