【裁判要旨】外国法院判决在未获我国法院承认的情况下,不具有生效判决的法律效力,不得在我国的相关诉讼中直接作为确定双方当事人权利、义务的法律依据。但作为一份正式的书面材料,其可以作为证据,对当事人之间的婚姻和财产状况发挥一定的证明作用,人民法院应当对其进行严格审查、认证。■案号一审:(2009)海民初字第27700号二审:(2011)一中民终字第5688号重审后一审:(2011)海民初字第17364号二审:(2012)一中民终字第12357号
Key Points of Judgment Foreign court judgments, without the recognition of the courts of our country, do not have the force of law to take effect in judgments and shall not be directly used as the legal basis for determining the rights and obligations of both parties in the relevant litigation in our country. However, as an official written material, it can serve as evidence to prove the marriage and property status of the parties.
