随着改革开放以来我国房地产业的快速发展,当前房地产业出现了包括规划重复、占地过多等浪费问题以及环评缺失、施工扰民等环保问题。针对于此,本文分析了房地产开发建设中的主要环保法律问题,探讨了法律制度在房地产开发建设中的规范保护作用,并提出构建房地产环保管理法律制度体系的必要性及做法。
With the rapid development of China’s real estate industry since the reform and opening up, the current real estate industry has encountered environmental problems including repeated planning and excessive land occupation as well as lack of environmental impact assessment and construction nuisance. In view of this, this article analyzes the main environmental law issues in the real estate development and construction, discusses the normative protection of the legal system in the real estate development and construction, and puts forward the necessity and practice of building a legal system of environmental management of real estate.
