《最高人民法院关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》(后文简称《解释》)中第八、九条就惩罚性赔偿做了相应规定与例举,但其条款本身概念定义与法律依据等内容上存在缺陷,影响惩罚性赔偿在商品房合同纠纷中的适用。本文以购房合同中惩罚性赔偿所存在的问题为切入点,就其问题解决的策略方法做具体的研究探讨,希冀为提升惩罚性赔偿在商品房纠纷中的适用性与功用做出一定的建议。
Article 8 and 9 of the Interpretation of the Supreme People’s Court on Some Issues Concerning the Application of Law in the Trial of Disputes over Sales Contract for Commercial Real Estate (hereinafter referred to as “Interpretation”) made corresponding provisions and examples on punitive damages, but the definition of the terms itself Legal basis and other content flaws, affecting the punitive damages in commercial real estate contract disputes. This article takes the problems existing in the punitive damages in the purchase contract as the starting point, and makes a concrete research on the strategy and tactics to solve the problems, hoping to make some suggestions for improving the applicability and function of the punitive damages in the commercial disputes.
