文章旨在考察美国国际贸易委员会(ITC)在裁定对华反倾销案件过程中受哪些因素的影响,是否具有针对中国的歧视性。通过对1980年至2005年ITC裁定对华反倾销案件结果和影响因素的经验分析,得出结论:案件申诉者的政治势力对裁定结果发挥着至关重要的影响;ITC对于是否构成损害的裁定结果强烈依赖于案件是否专对中国发起;其他政治经济因素均不能对裁定结果产生显著影响。
The article aims to examine whether the United States International Trade Commission (ITC) is discriminating against China in determining the anti-dumping cases against China. Through the empirical analysis of the ITC’s findings on the anti-dumping cases against China from 1980 to 2005, it concludes that the political power of the petitioners plays a crucial role in determining the outcome of the arbitration and that ITC’s decision on whether to cause damages Strongly dependent on whether the case was launched specifically for China; other political and economic factors can not have a significant impact on the ruling.
