伴随着国际人权法的发展,医疗保健权是否可以成为一种宪法权利,在各国都有着各自不同的讨论。美国、加拿大、南非是其中较为典型的三个国家,分析探讨这三个国家中,该权利所具有的不同法律地位,进而围绕法院对待医疗保健权的不同态度加以阐释,不仅可以让我们了解该权利的特殊性与复杂性,同时也可对中国现状下该权利的实现以及保障有所启示。
With the development of international human rights law, whether the right to health care can become a constitutional right has its own different discussion in all countries.
