2012年《中华人民共和国刑事诉讼法修正案》增加强制证人出庭作证的规定,可谓开启了中国强制证人出庭制度的先河。此举意在保证证人证言的真实性、可靠性,标志以庭审为中心的刑事诉讼活动及制度的进一步规范和完善。同时,强制证人出庭制度本身存在的缺陷以及配套的具体制度、措施尚未完全落实,导致这一制度极易被束之高阁而成一纸具文。本文通过对该制度的论证,并结合司法实务工作的具体做法,明确强制证人出庭作证制度的合理性和必要性,分析该制度目前面临的现实困境。
The 2012 Provisions on Amendment to Criminal Procedure Law of the People’s Republic of China to increase the requirement for compelling witnesses to testify in court can be said to have opened the way for China to compel witness appearances in court. This move is intended to ensure the authenticity and reliability of witness testimony and to further standardize and perfect the criminal proceedings and court system that focuses on the trial. At the same time, the shortcomings of compelling the appearance of witnesses in court and the specific system and measure of supporting them have not yet been fully implemented, which makes the system extremely easy to be put on the shelf. Through the demonstration of this system and combining with the practice of judicial practice, this article clarifies the rationality and necessity of compelling the witness to testify in court, and analyzes the current dilemma facing the system.
