2017年7月1日施行的《劳动人事争议仲裁办案规则》第2条以列举加概括的方式规定了劳动人事争议仲裁的受案范围,实践中,一般是在此基础上以排除法确定其不予受理的范围。为进一步了解劳动人事争议仲裁不予受理的情形,笔者以湖南省某劳动人事争议仲裁委员会(以下简称“该仲裁委”)为对象展开调查,调查内容是该仲裁委不予受理案件的主要类型及其原因。在对该仲裁委近5年的不予受理案卷进行收集、整理和分析的同时,笔者对该仲裁委连续3个月的立案
